Understanding Image Usage Rights & Commercial Licensing

(For All Impresio Studio Clients)

When you book a photoshoot with Impresio Studio, you are paying for the photography service — which includes the shoot, editing, time, expertise, and delivery of final images.

You are not automatically buying the copyright or unlimited commercial usage rights, unless clearly mentioned in your package.

Because clients often have different needs, we provide a very clear, transparent rights structure that allows you to use your photos in the correct way without confusion.

1. What Clients Can Do (Included by Default)

All clients, regardless of the type of shoot, can:

Download their images

Print their images for personal use

Store and back up photos

Share photos with family and friends

Upload on their personal social media

Use in personal albums, frames, and posters

These rights are included in every booking.

2. What Requires Commercial Licensing

The following are not included in a normal photography package unless the package specifically mentions commercial usage:

Business promotion

Brand advertising

Paid ads (Meta, Google, YouTube, etc.)

E-commerce listing (Amazon, Flipkart, Shopify, Nykaa, etc.)

Packaging and labels

Menus, brochures, flyers, catalogues

Product marketing, banners, store displays

Outdoor advertising (hoardings, billboards, kiosks)

Resale or sublicensing of images

Media/PR usage

News publications

Use of images in AI training or generative AI tools

These uses require a commercial license, because they involve brand profit, marketing, or mass distribution.

**3. For Food, Product & Business Clients

(Commercial Shoots)**

Most product/food/business shoots automatically include commercial usage suitable for:

E-commerce listing

Brand website

Social media content

Basic marketing material

Digital promotions

Menu/e-commerce updates

However, the following still require an extended license or buyout:

Packaging designs

Large-scale advertising campaigns

Market-wide product launches

Outdoor hoardings or billboards

Magazine ads, newspaper ads, large print campaigns

Exclusive brand ownership

Transferable or resale usage rights

Worldwide perpetual rights

These require additional permissions because they involve mass-print, global distribution, or brand exclusivity.

4. For Maternity, Newborn & Family Clients

These sessions include a personal-use license only, meaning:

You may:

Print photos for home

Store, save, back up

Share in family WhatsApp groups

You may not:

Use images for brand promotion

Submit images to contests or magazines

Sell or transfer images

Use images in business

Advertise with the images

Train AI models with the images

If you want to use the photos commercially (e.g., maternity fashion brands, pregnancy products, influencers), you can request a commercial license.

5. Why Commercial Licensing Exists

Commercial images can be used to generate revenue for a brand.

A commercial license protects:

Your brand

The models’ rights

The studio’s original creative work

Legal use across different media

Fair pricing based on usage

The difference between personal and brand value

It ensures proper permission for public or business-facing use.

6. Two Types of Commercial Rights Available

A) Commercial Use License

Allows use for marketing, promotion, website, social media, ads, catalogues, packaging (if included), and more.

Specifies:

Duration (1 year / 3 years / 5 years / perpetual)

Territory (India / worldwide)

Media (digital / print / advertising / packaging)

Exclusivity (exclusive/non-exclusive)

Most clients use this license.

B) Copyright Buyout (Full Ownership)

You become the full owner of the images.

You can use, modify, resell, or sublicense without restrictions.

This requires a one-time buyout fee and written agreement.

7. What Is NOT Allowed Unless Specifically Mentioned

Clients may not:

Sell images

Give images to another photographer or agency

Allow brands to use images without license

Train AI or machine learning using images

Transfer or sublicense images

Use images beyond purchased duration

Use images for high-budget campaigns without permission

Apply heavy filters that alter the look of the work

Submit the images to competitions or media without permission

8. Why These Protections Are Important

Photography is intellectual property. These rules protect:

Brand consistency

Model rights

Pricing fairness

Trademark and copyright laws

Misuse prevention

Legal compliance for clients

Every professional studio follows similar practices.

9. Requesting Commercial Rights or Buyout

To request commercial usage or full copyright, provide:

Company name

Intended use (ads, packaging, website, e-commerce, etc.)

Duration needed

Territory (India or worldwide)

Number of images

Exclusivity requirements (if any)

Gallery links or filenames

We will respond with the license quote and documentation.
